Terms of use
The terms that apply when using Nallo.
These Terms of Use form an agreement between you and DSpark LLC, the operator of Nallo, and govern your access to the service. The Site is currently in pre-launch development. DSpark LLC’s registered address, verified support contact, governing law, and dispute forum must be published before public launch and before Checkout is enabled.
Agreement and eligibility
By using Nallo, you agree to these Terms and the Privacy Policy. You must be legally able to enter into this agreement and meet the minimum age required for online services in your jurisdiction. If you use the service for an organization, you represent that you are authorized to bind that organization.
Accounts
You are responsible for activity performed through your account and for keeping your authentication method secure. Provide accurate information, do not share access in a way that compromises the service, and notify the production support channel if you suspect unauthorized use.
Your prompts, uploads, and outputs
You retain whatever rights you already hold in prompts and source media you submit. You grant the service a limited license to host, copy, transform, transmit, and process that content only as needed to operate, secure, and improve the requested service.
You are responsible for confirming that you have the necessary rights and permissions for submitted content and for how you use generated output. Generated output may resemble existing people, places, styles, or works, and may not be unique. The service does not guarantee that an output is protectable, non-infringing, accurate, or suitable for a particular use.
Acceptable use
You may use Nallo for lawful, general-audience creative work. You must not:
- submit illegal, exploitative, non-consensual, or abusive content;
- impersonate a person or misrepresent generated media as authentic evidence;
- infringe privacy, publicity, copyright, trademark, or other rights;
- bypass access controls, Credit accounting, rate limits, or security measures;
- probe, disrupt, overload, reverse engineer, or misuse the service or its providers;
- distribute malware or use the service to facilitate fraud or harassment; or
- resell access or automate high-volume use unless expressly authorized.
Content or accounts may be restricted when reasonably necessary to enforce these rules, protect users, comply with law, or preserve service integrity.
AI service limitations
Generation is probabilistic. Outputs, processing times, model availability, resolution, duration, and Credit cost may change with the selected model and published controls. Review outputs before relying on them. Nallo is not intended for medical, legal, financial, safety-critical, or other high-stakes decisions.
Credits, plans, and payments
Credits are service units, not money, and cannot be transferred or redeemed for cash unless required by law. The price, Credit grant, renewal interval, included capabilities, and payment availability shown at Checkout govern a purchase. Taxes and provider fees may apply.
The current pre-launch Get Started buttons do not initiate a purchase. When recurring plans are enabled, they renew at the disclosed interval until cancelled. Cancellation stops future renewal but does not automatically create a partial refund for the current period. Refunds are governed by the Refund Policy and applicable law.
Service changes and availability
Models, providers, controls, pricing, Credit costs, storage periods, and features may change. The service may be interrupted for maintenance, provider failures, security response, or events outside reasonable control. No uninterrupted or error-free availability is promised.
Suspension and termination
Access may be suspended or terminated for material breach, unlawful activity, security risk, non-payment, abuse, or when required by law. You may stop using the service at any time. Provisions that by their nature should survive termination—including rights, payment obligations, disclaimers, and liability limits—continue to apply.
Disclaimers and limitation of liability
To the maximum extent permitted by law, the service and generated outputs are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. To the maximum extent permitted by law, DSpark LLC and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from use of the service.
Nothing in these Terms excludes rights or liabilities that cannot legally be excluded. Final production terms must state the applicable liability cap, governing law, and dispute process before paid access is offered.
Changes to these Terms
These Terms may be updated as the service or applicable requirements change. Material changes will be identified by a revised date and any notice required by law. Continuing to use the service after an effective update constitutes acceptance where permitted.
